Bird & Bird in fintech and crypto law

Legal 500 names Michael Jünemann as head of Bird & Bird's German fintech practice and lists 21Shares and Bitcoin Suisse (Europe) among its clients. Legal 500 also names the firm's role as lead contractor of the EU Blockchain Sandbox, the European Commission's regulatory sandbox for blockchain projects. Bird & Bird's tokens and tokenization practice belongs to a cross-practice group for digital rights and assets.

On MiCAR the firm publishes Road to MiCAR, a guide with contributions from its offices in several countries, including Germany, and updates it as the rules change. Its MiCAR tracker follows how each member state implements the regulation.

The rules Bird & Bird works on

Since June 30, 2024, issuers of stablecoins in the EU have had to meet MiCAR's rules for e-money tokens and asset-referenced tokens, and since December 30, 2024, crypto-asset service providers have needed a license. In Germany BaFin grants that license, and a bank that holds crypto for clients also works under the Banking Act (KWG). The pages on MiCA in Germany and the CASP license explain the procedure.

Tokenized bonds and fund units follow the Electronic Securities Act (eWpG), and trading venues for tokenized securities use the EU DLT Pilot Regime. Payment services follow PSD2, and PSD3 and the Payment Services Regulation are on the way. Finance Loop's overview of European law firms for digital assets compares Bird & Bird with the firms that advise in these fields.
