Crypto Asset Tracing

A stolen or hidden crypto asset does not disappear; it moves to another wallet, and that move stays on the public ledger. Crypto asset tracing follows that path, address by address, to find out where the funds sit today and who controls them. Victims of fraud, insolvency administrators and law firms all rely on it before a court can freeze or return anything, because a freezing order needs a specific wallet to target, not a general suspicion.

From a stolen coin to a named wallet

Tracing starts with the transaction that moved the funds out of the victim's control: a hack, an unauthorized transfer, a fraudulent instruction to move crypto held for someone else. From there, an investigator follows every hop the funds take, notes where they split across several wallets or route through a swap between different tokens, and marks the point where they land in a wallet that an exchange, a custodian or a payment processor can identify. That final step matters most: a wallet with no link to an identified service stays a set of characters on a ledger, while a wallet that touched an exchange running KYC checks can be tied to a name through a subpoena or a mutual legal assistance request.

The EU's Asset Recovery Directive brings crypto in scope

Member states had asset recovery offices for decades before crypto existed, built to trace and freeze the proceeds of crime across borders. Directive (EU) 2024/1260, adopted in April 2024, updates that framework and requires every member state to build tracing, freezing, confiscation and asset management procedures that explicitly cover crypto-assets, not only bank accounts and property. Germany implements freezing and confiscation of crypto assets through the general rules of the Strafgesetzbuch, sections 73 and following, and the procedural powers in sections 111b and following of the Strafprozessordnung; neither law names cryptocurrencies specifically, so courts apply the general property rules to wallets and private keys.

A German ruling on what a court can actually confiscate

A civil case tied to bitcoin proceeds from a shut-down darknet marketplace reached the regional court in Dresden, which ruled on whether a third party's crypto holdings at an exchange could be confiscated in the criminal proceeding. The decision underlined a practical limit tracing has to work around: a court order needs a specific, identifiable wallet or account under a specific party's control, so an investigation that stops at a mixer or a cross-chain bridge without resolving the final destination gives a court nothing concrete to order.

Who traces crypto assets, and for what

Fraud victims and their lawyers commission tracing to support a freezing application. Insolvency administrators use it to find crypto assets a debtor moved before filing, which then count toward the estate. Banks and exchanges run the same analysis internally under their GwG duties, checking whether funds arriving at their platform have a criminal history before they accept the deposit. Each of these uses the same underlying technique, a transaction graph built from public blockchain data, applied to a different legal question.

Upcoming events on compliance and digital assets

Finance Loop and crypto asset tracing

Finance Loop connects the compliance officers, fraud teams and lawyers who deal with crypto asset tracing at events such as When Banks Say 'No' in Frankfurt, where sanctions and anti-money laundering law were on the agenda alongside blockchain investigation methods. The topic belongs to Finance Loop's Risk & Compliance track, next to blockchain forensics and crypto litigation.

What is asset tracing in crypto cases?

Asset tracing in a crypto case means rebuilding the path funds took after a theft, fraud or hidden transfer, address by address, until they reach a wallet an exchange or custodian can identify. The result supports a freezing application, an insolvency claim or a criminal case, depending on who commissions the trace.

Can a frozen crypto wallet really be recovered?

Recovery depends on whether the funds reach a wallet a court or authority can act against. Once tracing identifies an exchange account holding the funds, a freezing order under the EU's Asset Recovery Directive or a German court's confiscation order under the Strafgesetzbuch can reach that account. Funds that stay in wallets with no identified custodian are harder to freeze, whatever a tracing report finds.

How long does crypto asset tracing take?

The timeline depends on how many hops the funds took and whether they passed through a service that keeps identity records. A trace that ends at a regulated exchange can move to a legal request within days; one that crosses several mixers or bridges takes longer and sometimes never resolves to a named party, since a well-obscured path can exceed what public blockchain data alone can show.
