Why Frankfurt treats crypto assets as a regulated asset class
A crypto asset traded or held through a Frankfurt institution sits inside the same supervisory structure as a stock or a bond, not outside it. BaFin, headquartered in Bonn with a large presence in Frankfurt, is the national authority for the EU's Markets in Crypto-Assets Regulation (MiCA), while the European Securities and Markets Authority writes the technical standards that turn MiCA into operating rules across the EU. The distinction that matters most for a Frankfurt institution is between a crypto-asset under MiCA and a security under German law. Germany's Electronic Securities Act (eWpG) lets an issuer put a bond or a fund share on a blockchain as an electronic security. Under Article 59 of MiCA, an investment firm authorized for tokenized financial instruments can passport that license across the EU within 40 days, which is why several German banks now plan their tokenization projects around a securities license instead of a crypto-asset license.
Custody: banks move from crypto pilots to licensed services
Deutsche Bank is seeking a MiCA license for institutional custody of bitcoin and ether, with a rollout planned before the end of 2026 that also covers the stablecoins USDC, EURC and EURAU. A MiCA custody license lets a bank hold private keys for institutional clients under the same supervisory regime that already governs its securities custody, which is what separates a licensed Frankfurt custodian from an offshore exchange wallet.
Deutsche Börse Group, through its subsidiary Crypto Finance, already runs custody and staking services for institutional clients from Frankfurt and Zurich, and Clearstream, the group's settlement arm, added several more cryptocurrencies to its institutional custody offering in 2026. A custody license under MiCA and a KWG banking license are separate approvals, so a bank that already holds securities for clients still needs the crypto-specific authorization before it touches a client's bitcoin.
Tokenized securities and real-world assets
A tokenized security in Germany is a security first: it falls under MiFID II and the eWpG, not under MiCA, because MiCA explicitly excludes financial instruments that are already regulated elsewhere. A Frankfurt bank or fintech that tokenizes a bond, a fund share or a real-world asset such as real estate needs the same investment-firm authorization it would need for a paper security, plus the technical setup to issue and settle it on a distributed ledger.
